(授業の概要・目的) | この講義では、私たちの日々の暮らしを支えている社会保障の制度についての正確な理解を得ることを主な目的とする。 社会保障とは、国民の生活保障を目的として、稼得生活が中断したり稼働能力が損なわれたりしたときに一定の所得を保障し、あるいは、ニーズを有する者に医療や福祉のサービスの利用を保障する制度をいう。日本では、憲法25条に定められた生存権の保障を具体化するものとして戦後に発展してきたが、今日では少子高齢化をはじめとする社会・経済・政治的な環境の変化への対応を迫られており、制度の持続可能性が懸念されている状況にある。 社会保障制度については人々の関心も高く、そのあり方をめぐってさまざまな主張が交わされているが、議論の中で往々にして見落とされがちなのが、制度は法によって創設され、法に基づいて運用されるものであるという点である。社会保障制度の課題とあり方を、社会を担う一人一人が自分の問題として考えるために、この講義では、現在の社会保障制度について、それを基礎づけている法律の条文等を参照しながら、可能な限り網羅的に概観していくこととする。 |

(授業の概要・目的) | 規格化された経済学をそのまま祖述するのではなく、経済学の歴史を、おもに貨幣という視角から通覧することによって、経済学への導入を図る。経済学の歴史を通覧すると、マルクス経済学と近代経済学の2つだけでなく、学派の数だけ3つも4つも、あるいはそれ以上に理論が存在することを思い知るであろう。しかしこのことは、理論が時代と地域の特殊性に制約されるという、ありふれた相対主義を意味するわけではない。この講義では、経済学の隣接諸分野をも射程に入れて、異分野にまたがる初学者を経済学に導きいれる工夫をする。それと同時に、経済学のあらたな対立軸を模索することを試みたいと思う。前期の経済学Ⅰでは、経済とは何か、経済人とは何か、貨幣とは何か、という本質的問いを古典古代にまで遡って追究する。 |

(授業の概要・目的)
日本国憲法は、多様な人々が共生していくための統治の基本的な仕組みを定めている。本授業では、その仕組みとそれを支える思想について、基礎的な知識を講義する。
具体的には、まず、憲法の統治の仕組みを支える近代立憲主義の思想とその歴史的展開について説明する。その後、憲法の定める司法制度・政治制度と、それらをめぐる諸問題について講義する。 なお、憲法は、日本の統治の基本的な仕組みを定めるとともに、基本的人権も保障している。後者については「日本国憲法」の授業で詳しく説明するので、同科目も併せて受講することを推奨する。 |

本授業では、日本国憲法の定める統治の仕組みとそれを支える思想について体系的に理解し、現代の様々な政治現象を憲法の視点から主体的に評価できる能力を修得することを目標とする。

(授業計画と内容)
はじめに憲法総論的な内容を扱った上で(「2.憲法の基礎理論」)、統治機構に関する諸問題について説明する(「3.日本国憲法の定める司法制度」「4.日本国憲法の定める政治制度」)。体系性を重視しながら、概ね以下のような流れで行う。各項目につき、1-2回程度の授業を予定しているが、受講生の理解状況や時事的な問題状況等に応じて、取り扱う内容や順序、配分時間数等を変更することがある。(授業回数はフィードバックを含め全15回とする。) 1.オリエンテーション 憲法を学習する意義、授業の進め方 2.憲法の基礎理論 1)憲法の概念 2)近代憲法の歴史 3)憲法改正 3.日本国憲法の定める司法制度 1)裁判所 2)違憲審査制 4.日本国憲法の定める政治制度 1)議院内閣制 2)国会 3)内閣 5.試 験 |

(授業の概要・目的)
私たちの日常生活を取り巻いている法という仕組みに関する学問が法学である。本講義では、法の知識に触れつつも、方法や思考枠組みに重点を置く。すなわち、日本法の基本的内容を広く紹介するというよりも、法を用いて紛争解決をしていく際の作法と思考方法に焦点を合わせることで、法学(特に法解釈学)という分野の基本的な特徴を伝えることを目的とする。

(授業の概要・目的) | The problem of what constitutes a fair and just society has been a recurring topic not only for philosophers and lawyers but for human beings in general throughout history. The first half of this course introduces the main theories of justice developed both within and without the Western milieu taking a historical and a multicultural angle. The second half of this course deals with Human Rights both as a model of justice and as an international standard. The philosophical foundations of the notion of human rights, as well as its criticism, will be addressed from the perspective of contemporary thinkers from different schools by also considering the problem of the universalism-relativism dilemma. Moreover, issues concerning the efficacy of the instrument, both from an international and a constitutional point of view, will also be addressed to provide a comprehensive frame (philosophical, legal and political) for the students. | ||||||
